Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs use of the services provided by IQ8 Technology, Inc. (“IQ8”) and is incorporated by reference into the agreement between IQ8 and the customer governing the services (the “Agreement”). Capitalized terms not defined here have the meanings given in the Agreement. IQ8 may update this AUP from time to time in accordance with the Agreement; the current version is available at iq8.ai/aup. This AUP controls over the Agreement solely with respect to the subject of acceptable use of the Platform; in all other respects the Agreement controls.
1. Purpose
This AUP describes prohibited uses of the Platform. It exists to protect IQ8, its customers, and the public, and to ensure the security, integrity, availability, and lawful use of the Platform. Customer is responsible for its Authorized Users’ compliance with this AUP and for any use of the Platform through Customer’s account.
2. Prohibited Activities
Customer will not use, and will not permit any Authorized User or third party to use, the Platform to:
2.1 Unlawful and Harmful Use
- Violate any applicable law, regulation, or third-party right, or promote illegal activity.
- Store, transmit, or make available material that infringes or misappropriates intellectual property or other proprietary rights.
- Store or transmit material that is defamatory, harassing, threatening, or unlawfully discriminatory.
- Exploit, harm, or attempt to exploit or harm minors, or store or transmit child sexual abuse material.
2.2 Security Violations
- Gain or attempt to gain unauthorized access to the Platform, related systems, networks, or data, or to any account not belonging to Customer.
- Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measure, without IQ8’s prior written authorization.
- Interfere with or disrupt the integrity or performance of the Platform, including through denial-of-service attacks.
- Introduce or transmit viruses, worms, malware, or other malicious or harmful code.
2.3 Network and Resource Abuse
- Send unsolicited bulk or commercial messages (spam), or violate anti-spam laws such as the CAN-SPAM Act.
- Use the Platform in a manner that imposes an unreasonable or disproportionate load on IQ8’s infrastructure, or that exceeds applicable usage limits.
- Use automated means to access the Platform in a way that adversely affects the Platform or circumvents technical restrictions, except through interfaces and within limits that IQ8 expressly permits.
2.4 Misuse of the Platform
The Platform-use restrictions in Section 4 of the Agreement (including its restrictions on reselling or sublicensing the Platform, reverse engineering, and building or benchmarking a competing product or service) apply in addition to this AUP and are not repeated here. Without limiting those restrictions, Customer will not, and will not permit any Authorized User or third party to:
- Misrepresent identity or affiliation, or impersonate any person or entity, in connection with use of the Platform.
- Misrepresent Output as human-generated work product or as the legal advice of a licensed attorney or otherwise conceal the AI-generated nature of Output, where such representation or concealment would be false or misleading or would violate applicable law, professional or ethical obligations, or a duty owed to a third party.
- Circumvent, disable, or exceed any rate limit, quota, Credit allowance, or other technical or usage restriction of the Platform, or use any automated or scripted means to do so.
- Produce malware, credential theft, deceptive impersonation/deepfakes, unlawful biometric identification or sensitive-attribute inference, illegal surveillance, or circumvention of AI safety measures.
3. Decision Making
Customer will not use the Platform as the sole basis for making decisions that produce legal, regulatory, employment, financial, healthcare, housing, credit, educational, or similarly significant effects concerning an individual, unless Customer has implemented appropriate human review, legal authority, notices, consents, testing, documentation, and other safeguards required by applicable law.
4. Data Responsibilities
Customer is responsible for the data it submits to the Platform and for ensuring it has the necessary rights and consents to do so. Unless an Order Form expressly permits, Customer will not submit to the Platform any specially regulated data that imposes obligations beyond those in the Agreement, such as protected health information subject to HIPAA, cardholder data subject to the PCI DSS, or government-classified information.
5. Customer Security Obligations
Customer will: (a) safeguard account credentials and restrict access to Authorized Users; (b) require Authorized Users to use unique credentials and, where available, multi-factor authentication; (c) promptly deactivate access for users who no longer require it; and (d) promptly notify IQ8 of any suspected unauthorized access to or use of the Platform.
6. Reporting and Cooperation
Customer should report suspected violations of this AUP or security incidents involving the Platform to security@iq8.ai. Customer will reasonably cooperate with IQ8 to investigate and remediate suspected violations.
7. Enforcement and Suspension
If IQ8 reasonably determines that Customer or an Authorized User has violated this AUP, IQ8 may, consistent with the Agreement, suspend or limit access to the Platform. IQ8 will use reasonable efforts to provide notice and an opportunity to cure where practicable, but may act immediately, including without prior notice, where IQ8 reasonably believes the violation poses a security risk, may cause harm or liability, may disrupt the Platform or other customers, or involves unlawful conduct. Suspension under this AUP does not relieve Customer of its payment obligations, and repeated or material violations may constitute a material breach of the Agreement.
